Terms and Conditions of the LDHiver Online Store

I. General Provisions

  1. The LDHiver online store is operated by LUMIERE Julia Fyda with its registered office at ul. Lwowska 56/22, 33-300 Nowy Sącz, registered under the number NIP 7343550459.
  2. These terms and conditions define the rules for using the online store available at [https://ldhiver.eu].
  3. Contact with the store is possible via:
  4. The terms and conditions are available on the store's website and are provided free of charge to customers before the conclusion of the sales contract.

II. Definitions

  1. Seller – LUMIERE Julia Fyda, operating the LDHiver online store.
  2. Buyer – an individual, legal entity, or organizational unit making a purchase in the LDHiver store.
  3. Consumer – a Buyer who is a natural person making purchases not directly related to their business or professional activity.
  4. Product – a movable item available for sale in the LDHiver store.
  5. Sales Contract – a contract concluded between the Seller and the Buyer, concerning the purchase of products offered by the LDHiver store.

III. Store Usage Rules

  1. To place an order, the Buyer must be at least 18 years old and have full legal capacity.
  2. The store sells products through its website. Orders can be placed 24/7.
  3. The Buyer is required to provide true personal data necessary for the fulfillment of the order.

IV. Ordering Procedure

  1. The Buyer selects products by adding them to the cart.
  2. After selecting products, the Buyer proceeds to the order form, where they provide the necessary data and choose the delivery and payment method.
  3. The order is placed after the Buyer confirms the content of the order and accepts these terms and conditions.
  4. After placing the order, the Buyer receives an order confirmation via the provided email address.

V. Prices and Payment Methods

  1. All product prices are in Polish zloty and include VAT.
  2. The store offers the following payment methods:
    • Traditional bank transfer
    • Online payment (e.g., PayU, PayPal)
    • Payment on delivery
  3. The Seller reserves the right to change product prices and to launch and cancel promotional campaigns.

VI. Delivery

  1. Delivery of products is carried out in Europe.
  2. The Buyer covers delivery costs unless promotion conditions specify otherwise.
  3. The order processing time is 4-6 business days from the moment the payment is credited to the Seller's account.

VII. Right to Withdraw from the Contract

  1. The Consumer has the right to withdraw from the sales contract without providing a reason within 14 days of receiving the ordered product.
  2. To exercise the right of withdrawal, the Consumer must notify the Seller of their decision via a clear statement (e.g., by letter, fax, or email).
  3. The Consumer bears the cost of returning the product.

VIII. Complaints

  1. The Seller is obliged to deliver products free from defects.
  2. If the product is found to be defective, the Buyer has the right to submit a complaint.
  3. The complaint must be submitted in writing or electronically to the Seller's address.
  4. Complaints are reviewed within 14 days from the date the Seller receives the properly completed complaint form or additional information if requested by the Seller.

IX. Personal Data Protection

  1. The administrator of the Buyers' personal data is Lumiere Julia Fyda.
  2. Personal data is processed for the purpose of fulfilling the order and, with the Buyer's consent, for marketing purposes.
  3. The Buyer has the right to access and correct their personal data.

X. Final Provisions

  1. These terms and conditions are effective from July 31, 2024.
  2. The Seller reserves the right to amend the terms and conditions. Changes take effect 7 days after being published on the store's website.
  3. In matters not covered by these terms and conditions, Polish law applies, including the Civil Code and the Consumer Rights Act.
